By accessing and using NCGC Exam Prep ("we," "us," or "our") practice test service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

NCGC Exam Prep provides practice tests designed to help users prepare for the NC General Contractor Exam. Our service includes:

3. No Guarantee of Passing

IMPORTANT: NCGC Exam Prep does not guarantee that you will pass the NC General Contractor Exam by purchasing or using our practice test. While our practice test is designed to simulate the actual exam experience and provide you with a realistic understanding of what the actual test will be like, success on the actual exam depends on many factors including, but not limited to:

• Your individual study habits and preparation
• Your understanding of the subject matter
• Your performance on the day of the exam
• Changes to the actual exam content or format
• Other factors beyond our control

Our practice test is intended to give you a feeling of what the actual test will be like and help you identify areas where you may need additional study. However, we make no representations or warranties regarding your ability to pass the actual exam.

4. Payment and Refund Policy

All payments for practice tests are processed through Stripe. By purchasing a practice test, you agree to pay the specified fee. All sales are final. We do not offer refunds for practice tests once they have been purchased and accessed, except as required by applicable law.

5. User Account and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating an account
• Keep your account information up to date
• Not share your account credentials with others
• Notify us immediately of any unauthorized use of your account
• Use the service only for lawful purposes

6. Intellectual Property

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NCGC EXAM PREP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the service
• Any failure to pass the actual exam
• Any unauthorized access to or use of our servers or data
• Any errors or omissions in any content
• Any interruption or cessation of transmission to or from the service

Our total liability to you for all claims arising from or related to the service shall not exceed the amount you paid for the practice test in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless NCGC Exam Prep, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the service
• Your violation of these Terms of Service
• Your violation of any rights of another party
